Luna Path may collect personal information directly from you when you contact Luna Path, book a session, complete forms, or during counselling sessions. In some cases, Luna Path may also receive personal information from other healthcare professionals involved in your care, with your consent, to ensure coordinated and effective support. Any personal information obtained from third parties will only be used in line with this privacy policy and handled securely.

 

In some circumstances, Luna Path may receive personal information from other sources relevant to your care or the administration of my counselling practice. This could include, for example, referrals from other professionals, information provided by family members with your consent, or publicly available sources. Any information obtained from these sources will be used only for legitimate purposes, handled securely, and in line with this privacy policy.

How long Luna Path keeps information

·       Adults: 7 years after the last session

·       Children / young people (under 18 at time of service): Kept until client turns 25 years old (or 7 years after the last contact, whichever is longer)

Duty of confidentiality

Luna Path is subject to a common law duty of confidentiality. However, there are circumstances where we will share relevant health and care information.

 

These are where:

·       you’ve provided Luna Path with your consent (Luna Path have taken it as implied to provide you with care, or you have given it explicitly for other uses);

·       Luna Path have a legal requirement (including court orders) to collect, share or use the data;

·       on a case-by-case basis, the public interest to collect, share and use the data overrides the public interest served by protecting the duty of confidentiality (for example sharing information with the police to support the detection or prevention of serious crime);

·       if in England or Wales: the requirements of The Health Service (Control of Patient Information) Regulations 2002 are satisfied; or

·       if in Scotland – Luna Path have the authority to share provided by the Chief Medical Officer for Scotland, the Chief Executive of NHS Scotland, the Public Benefit and Privacy Panel for Health and Social Care or other similar governance and scrutiny process.
